Offers and Pricing

The prices of our products are indicated in euros, all taxes included. CADENTIA reserves the right to modify them in case of an increase in the VAT rate, and in case of a manifest typographical or publication error.  

 

CADENTIA also reserves the right to modify its prices at any time. However, products will be invoiced based on the prices in effect at the time of your order confirmation. Products remain the property of CADENTIA until full payment of the price.

 

Our offers are valid while supplies last. The offer extends to mainland France, including Corsica. You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Confirmation of your order therefore constitutes acceptance of these General Terms and Conditions of Sale.

 

Unless proven otherwise, the data recorded by the site constitutes proof of all transactions between CADENTIA and its customers.  

 

In addition to the price of the products, you will have to pay a flat-rate contribution towards the shipping and handling costs of your order, the amount of which will be specified on the product page and on the order form before its confirmation. This contribution depends on the products ordered (weight, volume, commercial policy).

 

Sums paid in advance are not deposits.

Coupons and Discount Vouchers

To benefit from a discount voucher/credit, the customer must enter and validate their discount code in the designated field when confirming their order on the shopping cart page. 


Any promotions granted without the form of discount vouchers are only valid for one order per household, for a given validity period, and cannot be combined with other promotional offers.

Order Registration / Availability

Our product offers are valid as long as they are visible on the site, within the limits of available stock, excluding promotional offers explicitly stated as such on the sites. In the event of product unavailability after your order has been placed, we will inform you by email or telephone. Your order will be automatically cancelled and no bank debit will be made.

 

Each order is registered once payment has been made.

Any order validated by the consumer implies an irrevocable acceptance of the general terms and conditions of sale, which cannot be challenged.

 

CADENTIA reserves the right to refuse to make a delivery or to fulfill an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is ongoing. 

 

The company reserves the right not to accept an order from a dubious or unidentifiable source. In order to ensure the security of transactions and to address the concern of the majority to prevent fraud in distance selling, CADENTIA reserves the right to carry out checks on order placement. As part of a check, CADENTIA will invite you by email to send proof of address and identity. 

 

The delivery time only begins to run from the date of shipment of the order, which cannot be earlier than the validation of the supporting documents.

 

In the absence of supporting documents or if the documents sent do not make it possible to ascertain the identity of the person placing the order, or the reality of the domicile, we would be obliged to cancel the order.

Split payment

We offer 3 or 4-installment payment service with Alma.

 

Alma's credit service is offered for the settlement of purchases and the execution of payment, provided that the person purchasing the good or service through Alma ("Buyer") accepts the installment payment or deferred payment agreement.

 

Fees may be charged by Alma.

 

Any refusal by Alma to grant installment payment or deferred payment may result in the invalidation of the purchase agreement for the good or service ("T&Cs"), unless the Buyer agrees to pay the purchase amount in full.

 

In the event of termination of the T&Cs, the installment payment or deferred payment agreement will be automatically terminated.

 

In the event of withdrawal from the installment payment or deferred payment solution used for your payment, the T&Cs will be automatically terminated, unless you pay the amount of your purchase in full through Alma. If the product has already been shipped to you, you must return it within the maximum period provided for in these T&Cs.

Product Availability

The products offered on parfum-sur-mesure.com are of two types:

- personalized products: these require assembly and a variable manufacturing time. The average delivery time varies between 15 days and 2 months depending on the complexity of the product to be assembled. In all cases, the parties agree that the deadlines indicated on the site are only indicative for personalized products.

- non-personalized products: most of these are immediately available in our warehouse. However, some products are limited editions.

If the product offered on the site is out of stock, customer service will contact the customer to inform them, offer a new delivery time or an equivalent replacement product. The customer will also have the option to request the cancellation and refund of their order.

Delivery Terms

In mainland France: 

 

Orders received are processed within 24 hours and shipped within 48 hours. The announced delivery time is based on the merchandise dispatch date. Saturdays, Sundays and public holidays should be added to the initial delivery time. Order and delivery tracking is available on the website. The average shipping time is between 2 and 5 days.

 

Outside mainland France: 

 

Orders received are processed within 24 hours and shipped within 48 hours. Delivery times depend on the country and place of delivery. Served countries and destinations are automatically determined on the cart page. If you cannot select your country of delivery, it means that your country is not served by our transport partner. We invite you to contact our customer service if necessary to confirm whether your delivery address can be served.

Parcel Delivery

We use reliable and top-tier shipping partners.

 

In rare cases, a delivery delay or a lost package may occur. In the event of a delivery delay of more than 7 days, the customer must inform customer service, which will transmit the information to the shipping partner to initiate an investigation.

 

This investigation can last up to 21 days from its opening. If the package is found during this period, it will be immediately re-routed to the customer's home (in most cases). If, however, the package is not found after the 21-day investigation period, the carrier considers the package lost.

 

In this scenario, CADENTIA will send the customer a replacement package at its own expense. In the event that one or more lost products are unavailable at that time, CADENTIA will refund the customer the amount of these products.


At the start and throughout the investigation, CADENTIA may request supporting documents or evidence from the customer. Should these documents not be provided, CADENTIA will be unable to continue the investigation and any compensation would be suspended.

Receiving your parcels

Upon receipt of the package by the customer, it is imperative to check the general condition of the package. Any anomaly observed concerning the delivery (damage, package damaged and/or opened, broken products, etc.) must be obligatorily mentioned in writing in the form of detailed reservations on the delivery note, accompanied by your signature. It is specified that the mentions "subject to unpacking" annotated on the delivery note have no legal value.

 

You must immediately report the anomaly by phone or email to customer service so that a claim can be made to the carrier. Any claim beyond 48 hours after receipt of your package cannot be taken into account.

 

In case of a damaged package, we advise you to refuse delivery. We will send you a new replacement product. The contents of the order must be checked before opening sealed packaging. If you have not received the correct product or a product was missing, we will absolutely need photos of the package, as well as the products in sealed bags, for your claim to be taken into account.

 

Defective goods returned incomplete, damaged, or soiled by the customer will not be accepted and will be reshipped at the customer's expense. Products returned freight collect will be systematically refused.

 

After after-sales service intervention, the return of merchandise to the customer is at our expense. If it turns out that the returned material was not subject to a return authorization and/or that no defect covered by the warranty is found, no refund will be made, and if the customer wishes a reshipment, this will be at the customer's expense. Damage due to impacts is not covered by the manufacturer's warranty.

 

CADENTIA reserves the right at any time to request identity and address proofs for all orders to verify the communicated details and prevent any fraudulent use of the various services.

Returns / Return Policy

For non-customized products: 

 

In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 working days from the day of receipt of their package to exercise their legal right of withdrawal, i.e., to return, at their own expense, products that are not suitable.

 

In the case of a multiple order, meaning an order for several products, the refund period will run from the customer's notification of their wish to withdraw.

 

They are not obliged to give a reason for their withdrawal; however, they may inform CADENTIA. They will receive an acknowledgment of receipt by email from CADENTIA confirming their withdrawal has been taken into account.

 

You will need to make a request on our website through your personal account for the order concerned. You will need to include the following form, completed and signed, in your package:

 

The product must be returned to CADENTIA. Please note that each item must be returned in the same condition as at the time of receipt. New items must be returned new, unused, and complete, so that the customer can benefit from the right of withdrawal. The product must be returned to the address mentioned.

 

This right of withdrawal is exercised without penalty.

 

In the event of exercising the right of withdrawal, the customer may request a refund of the sums paid. Following your withdrawal request, CADENTIA, in accordance with legal provisions, will proceed with your refund within 14 days following the notification of your withdrawal request. In the absence of receipt of your product or proof of shipment of your product within this period, CADENTIA reserves the right to postpone your refund until the day of receipt of your product. 

 

CADENTIA will process your refund via the same payment method used on the day of your order, unless the payment method used does not allow it. Thus, if you paid for your order using a bank card (cash or in 4 installments), CADENTIA will refund you by crediting your bank card.

 

Please note: In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised if the ordered product has been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.

 

For customized products: 

 

In accordance with Article L.221-18 of the French Consumer Code, significantly customized products cannot be subject to withdrawal or return. 

Complaints

This contract is governed by French law. CADENTIA cannot be held responsible for damages of any kind, whether material, immaterial or physical, that may result from the misuse of the products sold.

 

In the event of difficulties in the application of this contract, the customer has the possibility, before any legal action, to seek an amicable solution, notably with the help of a professional association in the sector, a consumer association or any other advisor of their choice.

 

Complaints or disputes will always be received with benevolent attention, good faith always being presumed in the person who takes the trouble to explain their situation. In the event of a dispute, the customer will primarily contact the company to obtain an amicable solution.

 

In the absence of an amicable agreement between the Parties, the dispute will be submitted to the French courts, unless otherwise provided by law.

 

We would like to inform you that, within the framework of amicable procedures to which any difficulty must be submitted before referral to the competent courts, we can by mutual agreement notably implement the means permitted by Directive 2013/11/EU of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes, as well as those arising from Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes.

 

In the event of a complaint not resolved amicably by our Customer Service, and in accordance with article L612-1 of the Consumer Code, the customer can use the free CM2C mediation service, to which CADENTIA is a member, electronically at https://cm2c.net. The Mediator's service can be contacted for any consumer dispute whose resolution has not been successful.

 

Unless otherwise provided by mandatory legal provisions, any dispute not resolved through an amicable procedure shall be submitted to the competent court within the jurisdiction of the Paris Court of Appeal, to which jurisdiction is conferred, even in the case of summary proceedings, a third-party claim, or multiple defendants.

Legal Warranties

Regardless of the commercial warranty, and in accordance with regulations, CADENTIA undertakes to fulfill its obligations regarding the warranties attached to products sold on its website and in its various catalogs, as set out in the following articles from the Consumer Code and the Civil Code:

 

Consumer Code - article L217-4
The seller is bound to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was carried out by the seller under the contract or under the seller's responsibility.

 

Consumer Code - article L217-5
To conform to the contract, the goods must:
1) be fit for the purpose ordinarily expected of similar goods and, where applicable: - correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model: - have the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or their representative, particularly in advertising or labeling. 
2) or have the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter.

 

Consumer Code - article L217-7
Any lack of conformity that appears within twenty-four months from the delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise. The seller may rebut this presumption if it is incompatible with the nature of the goods or the alleged lack of conformity.

 

Consumer Code - article L217-9
In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. The seller is then obliged to proceed, unless impossible, according to the option not chosen by the buyer.

 

Consumer Code - article L217-12
Any action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.

 

Consumer Code - article L217-16
When the buyer asks the seller, during the commercial warranty granted at the time of acquisition or repair of movable property, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the buyer's request for intervention or the availability of the goods for repair, if this availability is subsequent to the request for intervention.

 

Civil Code - article 1641
The seller is bound by the warranty against hidden defects of the goods sold which render them unfit for their intended use, or which so diminish that use, that the buyer would not have acquired them, or would have paid a lower price for them, had they known of the defects.

 

Civil Code - article 1644
In the case of article 1641, the buyer has the choice of returning the goods and having the price refunded, or keeping the goods and having a part of the price refunded.

 

Civil Code - article 1648
The action resulting from redhibitory vices must be brought by the buyer within two years from the discovery of the vice.

 

Civil Code - article 2232
The postponement of the starting point, the suspension or the interruption of the limitation period cannot have the effect of extending the extinctive limitation period beyond twenty years from the day the right arose.

When you act under the legal guarantee of conformity, you:

  • have a period of two years from the delivery of the goods to take action;
  • can choose between repair or replacement of the goods, subject to the cost conditions provided for in article L. 217-9 of the Consumer Code;
  • are exempt from proving the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods;

This warranty applies independently of any commercial warranty that may have been granted. When you act under the warranty against hidden defects of the goods sold, you can choose between rescission of the sale or a reduction in the sale price.

Contractual information is presented in French and the products offered for sale comply with French regulations. If applicable, it is the responsibility of the foreign customer to check with local authorities the possibilities of using the product they intend to order. CADENTIA cannot be held liable in the event of non-compliance with the regulations of a foreign country.

 

These general terms of use and sale are governed by French law. In the event of persistent disagreement regarding the application, interpretation and execution of these terms, and failing an amicable agreement, any dispute shall fall within the jurisdiction of the competent French courts.
